Senators Fight Against Potential EPA Dust Regulation – Another Gov’t Agengy Run Amok

Farmers and ranchers getting fined for creating too much dust? As part of a Clean Air Act the Environmental Protection Agency is asking for twice as strict dust regulations. Some senators are asking the EPA to back off while it said regulating farmers is not part of its plan.
Their farm has been in John Greer's family for more than 120 years. He said dust is just part of the job.

"Marketing our grain, driving up and down our gravel or unimproved roads causes a lot of dust," said Greer.

That is not to mention handling livestock or harvesting crops. But as part of a five year review of Quantitative Health Risk Assessment for Particulate Matter - or dust - the EPA recommends stricter standards.

"We do not know how it is going to affect us but we are afraid it will affect us big time," Greer said.

They are not the only ones. 21 senators wrote EPA Administrator Lisa Jackson asking the EPA to back off. Senator Mike Johanns said the new standards would be devastating for Nebraska agriculture.

"You could go to just about anywhere in the state and we would either be bumping into that or actually over it and then you have all kinds of challenges in terms of how do you mitigate dust when you are out in the field and that sort of thing," said Johanns.

But an EPA spokesman said new rural regulations were never part of the plan.

"Contrary to blatantly false drum beat by agricultural alarmists, EPA does not have any plans to focus on regulating dust from farm fields or gravel roads," said Kris Lancaster, EPA, Region 7.

Lancaster said as part of the EPA's mission to protect public health the assessment focuses on significant sources of pollution most of which are in urban areas.
Senator Johanns asks if that were true why put agricultural regulations in their proposed assessment policy—which is the first step along the pathway to regulation? Between this and a recently withdrawn EPA proposal to monitor spilt milk, Johanns said it is too much.

"Why do they do these wacky things and then claim that we are the ones being alarmists? These folks drive me nuts. They are a federal department that just is out of control," Johanns said.

Meanwhile, it is the everyday farmers like Greer getting blown away with the wind.

Genetically Modified Canola Found Growing Wild in Dakota - (Video)

Genetically Modified canola has escaped into the wild and now are spreading out of control. Two GM strains have bred to produce a third. Monsanto, the creator of the plants, says there is nothing to worry about.

A University of Arkansas researcher has found genetically modified canola growing wild in Dakota -- but more than that, she found two different GM varieties had interbred to produce a completely new GM canola.

Dr. Cynthia Sagers, an ecologist with the University of Arkansas, presented her findings to the 9th Annual Meeting of the Ecological Society of America on Friday. Sagers said her findings showed there is a lack of "proper monitoring" and control of GM plants in the United States, reported Nature. Sagers said

"The extent of the escape is unprecedented."

NPR reported that all the varieties of GM canola that Sagers and her team found growing wild in Dakota were all modified to be resistant to Monsanto's herbicide Roundup, but at least two different GM varieties bred together to produce a third variety of GM with a new trait, prompting Sagers to say

"What we've demonstrated in this study is a large-scale escape of a genetically modified crop in the United States."

The paper, titled Evidence for the establishment and persistence of genetically modified canola populations in the U.S. The majority of the canola plants Sagers and her team collected while travelling 5,400 kilometers through Dakota were genetically modified. Her report concludes

"... These observations indicate feral populations are reproducing and have become established outside of cultivation making this is the first report in the U.S. of established populations of genetically modified organisms in the "wild". As such, these observations have important implications for the ecology and management of native and weedy species, and as well as for the management of biotech products in the U.S."

In a press release issued by the Ecological Society of America, Sagers was quoted as saying she had found

"... two instances of multiple transgenes in single individuals."

Monsanto downplayed the discovery, telling Nature

"Those familiar with canola know that these plants are readily found on roadsides and in areas near farmers' fields. This was true prior to the introduction of GM canola, and a common source is seed that has scattered during harvest and fallen off a truck during transport."

However, according to BBC, Sagers said her team collected canola samples from cemeteries, gas stations, ball parks, grocery stores and along roadsides. Sagers said her findings mean transgenic canola is capable of surviving in the wild, something some scientists say is not a major concern. NPR spoke with British researcher Mike Wilkinson, who said

"I wouldn't lose any sleep over it. It's very difficult for either of these transgene types to give much of an advantage, if any, in the habitats that they're in."

BBC reported that feral GM plants are expected. The plants that survive are called volunteers and they are known to reproduce. In spite of this fact, scientists think the only problem posed by the wild GM canola is weed control, because the wild canola will spread resistance to Roundup, a problem that has meant increased work and expenses for farmers. Environmental activists, however, are concerned about Dr. Sager's discovery. Reached via email on Friday, Eric Darier, Director of Greenpeace in Quebec, said

"15 years ago, those who opposed the dissemination of GE crop in the environment had concerns about the contamination of ecosystems. This is now what is happening! As there is no thorough and independent impacts studies it is difficult to know the unintended consequences that this genetic contamination will have on ecosystems and biodiversity. By the time we found out it might be too late. This news is also a very bad news for farmers and farming as more and more weeds will become more and more tolerant to the Roundup herbicide. This will force farmers to use greater quantities of even more toxic herbicides or to abandon land to weeds as it is already the case in many states in the US."

Monsanto has not denied the problem of "superweeds," acknowledging that herbicide-resistant weeds is a growing issue for farmers. In spite of this, the corporation still recommends use of its herbicide as a key component in controlling weeds in fields. "Superweeds" are created when GM plants interbreed with non GM plants of the same species, transferring genes and creating herbicide-resistant strains that subsequently become nuisances to farmers, choking out crops. 

Superweeds are also created when weeds survive applications of Roundup and then pass on the adaptive genes to offspring. GM canola is supposed to help farmers by increasing yields that require less inputs than non-GM canola. The Canola Council of Canada said GM canola is only modified to resist the herbicides applied to the fields, and oil made from the GM canola is identical to oil made from non-GM canola. GM canola is widely grown in western Canada, the USA and Australia. Organic producers are concerned about the contamination of their non-GM canola by GM canola. An Australian organization has created a map of where GM canola is grown in Western Australia to facilitate farmers who do not grow the GM crop.

At a time when our president and other politicians tend to apologize for our country's prior actions, here's a refresher on how some of our former patriots handled negative comments about our country.

 A Boeing engineer stood up and replied quietly:  "Our carriers have three hospitals on board that can treat several hundred people; they are nuclear powered and can supply emergency  electrical power to shore facilities; they have three  cafeterias with the capacity to feed 3,000 people three meals a day, they can produce several thousand gallons of fresh water from sea water each day, and they carry half a dozen helicopters for use in transporting victims and injured to and from their flight deck.  We have eleven such ships; how many does France have?"

A U.S. Navy Admiral was attending a naval conference that included Admirals from the U.S., English, Canadian, Australian and French Navies  At a cocktail reception, he found himself standing with a large group of officers that included personnel from most of those countries. Everyone was chatting away in English as they sipped their drinks but a French admiral suddenly complained that, whereas Europeans learn many languages, Americans learn only English. He then asked, "Why is it that we always have to speak English in these conferences rather than speaking French?"

 Without hesitating, the American Admiral replied, "Maybe it's because the Brit's, Canadians, Aussie's and Americans arranged it so you wouldn't have to speak German."

Robert Whiting, an elderly gentleman of 83, arrived in Paris by plane. At French Customs, he took a few minutes to locate his passport in his carry on.

"You have been to France before, monsieur?" the customs officer asked sarcastically.

Mr. Whiting admitted that he had been to France previously.

"Then you should know enough to have your passport ready."

The American said, "The last time I was here, I didn't have to show it."

"Impossible.. Americans always have to show their passports on arrival in France !"

The American senior gave the Frenchman a long hard look.  Then he quietly explained, ''Well, when I came ashore at Omaha Beach on D-Day in 1944 to help liberate this country, I couldn't find a single Frenchmen to show a passport to."

Virginia Rules Police Can Ask Suspects About Immigration Status - Another State Has The Cajones To Challenge Coddling of Illegal Aliens

In a decision that could lay the groundwork for an Arizona-style immigration policy, Virginia's attorney general said state law enforcement officers are allowed to check the immigration status of anyone "stopped or arrested." 

Attorney General Ken Cuccinelli issued the legal opinion Friday extending that authority to Virginia police in response to an inquiry over whether his state could mirror the policies passed into law in Arizona. 

"It is my opinion that Virginia law enforcement officers, including conservation officers may, like Arizona police officers, inquire into the immigration status of persons stopped or arrested," he wrote. 

The decision comes after a federal judge blocked Arizona from implementing its provision that would require law enforcement to check the immigration status of anyone they stop and suspect of being an illegal immigrant. 

Cuccinelli's ruling could justify that kind of policy in Virginia. However, Cuccinelli reiterated in the opinion a prior finding that while state officers have the authority to arrest suspects on criminal immigration violations, they are advised against arresting over civil immigration violations. Overstaying a visa would fall under the latter category. 

The state's top attorney wrote the opinion in response to a question from state Del. Bob Marshall, who represents Prince William County. 

Marshall's county implemented a law that requires police to check the immigration status of everyone they arrest -- but not everyone they come in legal contact with.

Don’t Look Now. Immigration Reform is Coming in the Back Door

While the activists and the rest of America are waiting for the next move by the Obama Administration on Immigration Reform, some twenty million illegal aliens are quietly waiting at the back door for amnesty. Foolish? Never happen? Think again.

President Obama and the Pelosi-Reid-Emmanuel cartel are about to get spanked on healthcare. They handled this like rank amateurs, which of course at least one of them is. They haven’t a clue what the American people really want nor do they care as they are blinded by their own visions of a social democracy fantasy-land where America no longer leads but follows. 

Trouble is, we’re following n the footsteps of those who have already failed at social democracy and national healthcare. Nice plan.

No, the healthcare initiative is not going well. If it does pass, it will look nothing like its proponents’ envisioned. Is it likely that fresh on the heals of this defeat, the President and Congress would stick their collective necks out once again to be sized up by the public for a silver platter? I think not.

For one thing, we're coming up on an election year and Harry Reid is in the fight for his political life in Nevada. So is Barbara Boxer in California where she may be facing formidable opponent and former CEO of HP Carly Firoina. None are going to want to raise the hackles of public dissent at least until after the elections are over. From the other side of this however, If they do not get what they want now, the door may shut for a long time. They may have to act, just not politically.

So as the activists on both sides of the debate gird their loins, shine their shields and sharpen their pencils and swords, the Administration is instead skillfully de-fanging the Department of Homeland Security and preparing to address Immigration Reform not as a part of the political process but as a bureaucratic one.

According to a well placed Homeland Security Administrator (who obviously prefers to remain anonymous), the wheels of deceit are already in motion as orders are out to scuttle ICE raids of companies hiring illegal workers, remove key elements of 287G policies, which give local law enforcement the ability to arrest illegal aliens, and to set the stage for the processing of millions of illegal immigrants as newly minted American citizens.

“The plan is to incrementally remove all obstacles for immigration reform without a public debate.” The confidential source said. “Amnesty is a 100% done deal already,” he added.

Not so fast.

Aren’t the American people supposed to weigh in on this through their elected representatives; a public that today is some 75% against amnesty? Well that would be true if the administration actually intended to have a public debate this time.  By all accounts…they do not. Or if they have one at all it will be so convoluted that most will be waiting for the other shoe to drop, which it will…on the back stoop.

Here is what you need to watch for in the coming weeks and months. Executive Orders and departmental pronouncements that limit the ability for law enforcement to do its job and a re-tasking of Federal Agents and bureaucrats to other “more important” duties like protecting MEXICO from evil American citizens with guns. Don’t underestimate Executive Orders.  As Clinton advisor Paul Begala once said about them: "Stroke of the pen…law of the land…kinda cool."  The Obama Administration is rife with Clintonista’s who made circling around a Republican Congress an art form.

Watch for the pieces of the immigration reform puzzle to be presented to congress incrementally as amendments that seemingly get tough on illegal immigration only to have their teeth pulled out once they are law through administrative procedures.  Excellent programs like E-verify may sail through only to be disassembled by bureaucrats. Other amendments will get passed by voice vote (so no one can claim responsibility) to appease the right and then bury them or dramatically alter them in committee.

Rumor has it the President has taken to doing magic tricks in his spare time. The sleight of hand skills required will serve him well in the coming months. Read every word of every bill and scrutinize the Amendments closely. Each time something having to so with immigration comes before Congress, call your Representative and tell them what you think. Let them know you are paying attention. Shut down the Senate switchboard once again if you have to. Do it every day. Use excellent free fax tools like those at NumbersUSA.com and throw them a few bucks if you can. I have gotten a written response from every legislator I have ever faxed. Someone reads them.

So the next few months should be interesting. Pundits on the left and right are now suggesting that Immigration Reform has already eclipsed Healthcare in the public spotlight.  More than 130 immigration reform advocates met at the White House last week to strategize. Many are funded in one way or another with your tax dollars.  They are preparing for a robust public debate.

Or are they?
